The advent of e-discovery has given birth to a new field of ancillary litigation — discovery about discovery. Parties are busy looking for what’s missing, in the hopes of making their opponent “the spoliator”. You see, once you label the opposing party as “the spoliator” the riches can be many – including an adverse inference jury instruction and cold, hard cash in the form of sanction.

So, it’s a good thing that this years’ overarching e-discovery theme is “perfection” – more accurately, a lack of perfection. It’s all right that your preservation, collection and production efforts aren’t perfect – as long as they are reasonable and performed in good faith. Consider the two most prominent cases of 2010 – Pension Comm. of the Univ. of Montreal Pension Plan v. Banc of Am. Sec., LLC , 685 F. Supp. 2d 456 (S.D.N.Y. 2010) and 269 F.R.D. 497 (D. Md. pt. 9, 2010) .

Perfection is not expected, but you cannot conduct discovery in an “ignorant and indifferent fashion.”

I have personally used almost all of the features and have been pleased all the way around.  The app has been updated several times since I bought it and it does get better each time.   The app seems very well suited for use by any professional who is required to keep his or her time and is simple to use, especially once you have input most of your client information over time.  Probably the biggest task is setting up your database of clients, billable entries, and related project/matter information.

Noteworthy are the facts that the app is compatible with Quickbooks, it can be synchronized between two devices (Ipad and your Iphone), and it will allow you to import contacts information from Outlook, AOL, or other address books.  Lastly, Time Master provides you with the ability to invoice immediately via e-mail and to print invoices as a .pdf file.

I give this app the highest recommendation after having regularly used it for the last year plus.

Microsoft Office 2011 Looks Promising for Mac Users

Computer Microsoft is releasing Office 2011 for Mac users on October 26, 2010.  If you already have purchased Office 2008 in the last couple of months, you get a free upgrade to 2011.  The office suite looks very promising.  Among other improvements to the suite, Office 2011 is including Outlook for Mac.  Up until now, they have offered Entourage, which is an ostensible version of Outlook with considerably less features and a less polished user interface.  With Outlook, calendar integration, task integration, and collaboration ought to be quite a bit easier.  As to the new version of Word, one can expect to see the “ribbon” user interface that is present in the PC version of the suite.  According to MS, Office for Mac 2011 gives you an enhanced user experience overall, as performance and launch times have been improved in Word, PowerPoint, and Excel. Your documents feel “lighter,” since they load fast, and respond quickly to your commands. And searching text within documents has never been faster.” Overall, this sounds like a worthy update to a program that needs to come up to speed for Mac users, especially those of us in the law. Try finding a usable pleading template for Mac Office 2008 some time !!!
